Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Rufly Ltd ("rufly", "we", "us"). They govern your access to and use of our website, account area and travel eSIM data services (the "Service").

By creating an account, placing an order, or using the Service, you confirm that you accept these Terms. If you do not agree, do not use the Service.

These Terms incorporate our Privacy Policy, Acceptable Use Policy and Fair Usage terms by reference.

• You must be at least 18 years old (or the age of majority where you live) and able to enter a binding contract.
• You must provide accurate account information and keep it up to date.
• You are responsible for safeguarding your login credentials and for all activity under your account.
• Notify us promptly at hello@rufly.co if you suspect unauthorised use of your account.

• rufly provides data-only eSIM plans for travel. The eSIM does not include a phone number and does not support voice calls or SMS over the eSIM. Keep your normal SIM for calls and texts.
• eSIMs require a compatible, carrier-unlocked device. It is your responsibility to confirm compatibility before purchase. We are not liable where your device does not support eSIM or is locked to another operator.
• Coverage, available networks and speeds depend on the destination, local operators and conditions outside our control. Stated coverage and speeds are indicative, not guaranteed.
• Plans are valid for the destination(s) and validity period shown at purchase. Validity periods generally begin on activation or first use, as described on the plan.

• Prices are shown at checkout in the currency selected and may be exclusive or inclusive of applicable taxes as indicated.
• Payment is taken at the time of purchase via our payment processor. We do not store full card details.
• Your order is accepted when we send your order confirmation and/or deliver your eSIM. We may refuse or cancel an order in cases of suspected fraud, error, or breach of these Terms.
• If a price or plan is listed incorrectly due to an obvious error, we may cancel the order and refund any amount paid.
• You are responsible for any data-roaming, device or third-party charges that are not part of the rufly plan.

• After successful payment, we deliver your eSIM by email (a QR code) and make it available in your account.
• Install your eSIM over Wi-Fi before you travel. In most cases, data only begins counting once you arrive at the destination and the eSIM connects to a local network.
• It is your responsibility to follow the installation and activation steps and to enable data roaming for the eSIM profile in your device settings.
• If you do not receive your QR code, check your spam folder and your account, then contact support. Do not delete an installed eSIM in an attempt to fix issues, as it usually cannot be reinstalled from the same code.

"Unlimited" plans are subject to fair usage to keep the network fast and fair for everyone. The applicable full-speed allowance, ongoing speed and hard caps are set out on our Fair Usage page and form part of these Terms.

Your use of the Service must comply with our Acceptable Use Policy. Misuse, fraud, reselling without authorisation, or use that harms the network or others may result in throttling, suspension or termination without refund.

Because eSIM data plans are digital and delivered immediately, the following applies:

• If your eSIM has not been installed or used, you may request a refund and, where applicable, you may have a statutory right of withdrawal that you agree may be limited once the digital service is fully performed.
• Once an eSIM has been activated and any data has been used, the plan is generally non-refundable, as with other data plans.
• If a plan fails to work because of a fault on our side and we cannot resolve it, we will provide a replacement or a fair refund.
• Refunds are made to the original payment method. Processing times depend on your payment provider.

To request a refund, contact hello@rufly.co with your order details. Refund requests are assessed against these Terms and applicable consumer law, which is not affected by anything in this section.

We donate 10% of every sale to help street dogs get fed, treated and housed. Donations are transferred monthly. Where we have a partner shelter in your eSIM's destination country, your share is routed there; otherwise it goes to our partner shelter fund.

Donation figures we publish reflect actual transfers and are provided for transparency. The donation is funded out of the price you pay and does not add a separate charge.

The Service, including the rufly name, branding, content, software and design, is owned by us or our licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your personal, non-commercial use in line with these Terms. You may not copy, modify, distribute, resell or create derivative works without our written permission.

The Service is provided on an 'as is' and 'as available' basis. To the fullest extent permitted by law, we disclaim all warranties not expressly stated, including fitness for a particular purpose and uninterrupted or error-free service.

We do not guarantee specific speeds, continuous coverage, or that the Service will be available in every location or at all times. Connectivity depends on local networks, your device and conditions beyond our control.

Nothing in these Terms excludes or limits liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud.

Subject to that, we are not liable for indirect, incidental, special or consequential losses, loss of profits, data, business or goodwill arising from your use of, or inability to use, the Service. Our total aggregate liability for any claim relating to the Service is limited to the amount you paid for the plan giving rise to the claim.

You agree to indemnify and hold us harmless from claims, losses, liabilities and reasonable expenses arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party rights.

We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms or the Acceptable Use Policy, if required by law, or to protect the Service or other users. You may stop using the Service at any time. Provisions that by their nature should survive termination will continue to apply.

We may update the Service and these Terms from time to time. When changes are material, we will update the 'last updated' date and, where appropriate, notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules. The courts of that jurisdiction will have exclusive jurisdiction, except that mandatory consumer protections in your country of residence continue to apply.

We'd always prefer to resolve issues directly, please contact legal@rufly.co first so we can try to put things right.

• If any provision is found unenforceable, the rest remain in effect.
• Our failure to enforce a right is not a waiver of it.
• You may not assign these Terms without our consent; we may assign them to a successor entity.
• These Terms, together with the policies referenced, are the entire agreement between you and us regarding the Service.
